This Privacy Policy of personal data (hereinafter — the «Privacy Policy») shall apply to all the information that the online store «Cascade», located on the domain name cascade.net.ua, can receive about the User while using the site of the Internet-shop, programs and products of the Internet-shop.

1. DEFINITION OF TERMS
1.1 The following terms are used in this Privacy Policy:

1.1.1 «Site Administration of the Online Store (hereinafter referred to as «Site Administration»)» — Authorized employees to manage the site, acting on behalf of «Cascade», which organizes and (or) conducts the processing of personal data, as well as determines the purpose of processing of personal data, the composition of personal data to be processed, the actions (operations) performed with personal data.

1.1.2. «Personal data» — any information relating to directly or indirectly identified or defined by an individual (personal data subject).

1.1.3. «Processing of personal data» — any action (operation) or set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.1.4 «Confidentiality of personal data» — mandatory for observance by the Operator or other person who obtained access to personal data, the requirement not to allow their dissemination without the consent of the subject of personal data or availability of other legal grounds.

1.1.5 «Online Store User (hereinafter «User»)» — a person who accesses the Site via the Internet and uses the Online Store’s Site.

1.1.6. «Cookies» — is a small piece of data, sent by a Web-server and stored on the user’s computer, which the Web-client or Web-browser sends each time the Web-server in HTTP-request when trying to open a page of the corresponding site.

1.1.7. «IP address» — the unique network address of a node in a computer network based on the IP protocol.

2. GENERAL PROVISIONS
2.1 The User’s use of the Online Store website means consent to this Privacy Policy and the terms of processing of the User’s personal data.

2.2 In case of disagreement with the terms of the Privacy Policy the User must stop using the Online Store’s website.

2.3. This Privacy Policy applies only to the site of the Internet-shop «Cascade». Internet-shop has no control over and is not responsible for the websites of third parties, to which the User can go through the links available on the site of the Internet-shop.

2.4. Administration of the site does not check the accuracy of personal data provided by the User of the site of the Internet store.

3. SUBJECT OF PRIVACY POLICY
3.1 The present Privacy Policy states the obligations of the Administration of the Online Shop website on nondisclosure and ensuring the protection of confidentiality of personal information, which the User provides at the request of the Administration of the website at the registration on the site of the Online Shop or when placing an order for the purchase of goods.

3.2. Personal information, allowed to be processed under this Privacy Policy, is provided by the User by filling the order placement form on the site of the Internet-shop «Cascade» in the «Order placement» section, and includes the following information

3.2.1. last name, first name, patronymic of the User;

3.2.2. contact phone number of the User;

3.2.3. email address (e-mail). 3.2.4;

3.2.4. address of Goods delivery;

3.2.5. the User’s place of residence.

3.3 The online store protects the Data, which is automatically transmitted in the process of viewing ad units and when visiting pages on which the system’s statistical script («pixel») is installed:

• IP address;
• information from cookies;
• information about the browser (or other program that accesses the advertising display);
• access time;
• address of the page where the ad block is located;
• referrer (address of the previous page).

3.3.1 Disabling cookies may prevent access to the parts of the Internet-shop site requiring authorization.

3.3.2 The online store collects statistics about the IP addresses of its visitors. This information is used to detect and resolve technical problems and to control the legality of financial payments.

3.4 Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) shall be stored securely and shall not be disclosed, except as set out in clauses 5.2. and 5.3. of this Privacy Policy.

4. PURPOSES OF COLLECTING PERSONAL INFORMATION OF THE USER
4.1 Personal information of the User can be used by the Administration of the online store for the following purposes:

4.1.1. Identification of the User, registered on the site of the online store, to place an order and (or) enter into an agreement of purchase and sale of goods by remote method with the online store «Cascade».

4.1.2 Providing the User with access to the personalized resources of the Internet-shop website.

4.1.3. establishing feedback with User, including sending notices, requests regarding the use of the online store’s Website, service delivery, processing of requests and applications from User.

4.1.4 Determining the location of the User for security purposes, fraud prevention.

4.1.5 Confirming the accuracy and completeness of personal data provided by the User.

4.1.6. Creating an account for making purchases, if the User has agreed to create an account.

4.1.7 Notifying the User of the Online Store about the status of the Order.

4.1.8. Processing and receiving payments, confirming tax or tax benefits, disputing the payment, determining the right to receive a credit line by the User.

4.1.9 provision of effective customer and technical support to the User in case of problems related to the use of the Online Store Website.

4.1.10. Providing to User with his consent, updates of products, special offers, information about prices, newsletters and other information on behalf of the Internet-shop or on behalf of partners of the Internet-shop.

4.1.11. carrying out advertising activities with the consent of the User.

4.1.12. Giving the User access to sites or services of the partners of the Online Store to get products, updates and services.

5. METHODS AND TERMS OF PROCESSING OF PERSONAL INFORMATION
5.1 Processing of personal data of the User shall be performed without limitation of time, by any legal means, including information systems of personal data with or without the use of automation tools.

5.2 The User agrees that the Administration of the site has the right to transfer the personal data to third parties, in particular, courier services, postal organizations, telecommunication operators, exclusively for the purpose of the User’s order, executed on the site of «Cascade» online store, including product delivery.

5.3 Personal data of the User can be given to the authorized bodies of state power of Ukraine only on the grounds and in the order established by the legislation of Ukraine.

5.4 In case of loss or disclosure of personal data the Administration of the site informs the User about the loss or disclosure of personal data.

5.5 The Administration takes necessary organizational and technical measures to protect personal information of the User from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

5.6 The Site Administration together with the User shall take all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of personal information of the User.

6. OBLIGATIONS OF THE PARTIES
6.1 The User shall:

6.1.1 Provide personal data information necessary to use the Website of the online store.

6.1.2 Update, supplement the provided information about personal data in case of changes in such information.

6.2 Administration of the site is obliged to:

6.2.1 Use the received information solely for the purposes specified in Clause 4 of this Privacy Policy.

6.2.2 Keep confidential information secret, not disclose it without prior written permission of User, as well as not to sell, exchange, publish or disclose in any other possible ways the personal data of User, except for items 5.2 and 5.3 of this Policy. 5.2. and 5.3. of this Privacy Policy.

6.2.3 Take precautionary measures to protect the confidentiality of the User’s personal data, according to the procedure generally used for the protection of such information in the existing business turnover.

6.2.4 To block personal data related to the relevant User from the moment of application or request of the User or its legal representative, or authorized body for protection of rights of subjects of personal data for the period of inspection, in case of unreliable personal data or unlawful actions.

7. RESPONSIBILITY OF THE PARTIES
7.1 The Administration of the site which has not fulfilled its obligations, bears responsibility for the losses the User suffers in connection with the unlawful use of personal data according to the legislation of Ukraine, except for the cases stipulated by the items. 5.2, 5.3. and 7.2. of this Privacy Policy.

7.2 In case of loss or disclosure of Confidential Information, the Site’s Administration is not responsible if this confidential information

7.2.1. Became public domain before its loss or disclosure.

7.2.2. was received from a third party prior to its receipt by the Administration.

7.2.3. has been disclosed with the consent of the User.

8. DISPUTE RESOLUTION
8.1 Before going to court to settle disputes arising from the relationship between the User of the Online Store and the Administration of the site, it is obligatory to file a claim (written offer to voluntarily settle a dispute).

8.2 Recipient of the claim within 30 calendar days from the date of receipt of the claim shall notify the claimant in writing of the outcome of the claim.

8.3 In case of failure to reach an agreement, the dispute will be transferred for consideration to the judicial authority in accordance with the current legislation of Ukraine.

8.4 The current legislation of Ukraine is applied to this Privacy Policy and the relations between the User and the Administration of the site.

9. ADDITIONAL CONDITIONS
9.1. The Administration of the Website has the right to make changes in this Privacy Policy without the consent of the User.

9.2. New Privacy Policy comes into effect from the moment of its publication on the Website, unless otherwise provided by the new Privacy Policy version.
